Terms and Conditions

THESE ARE THE TERMS AND CONDITIONS THAT GOVERN HOW THE “SAMSUNG SMART SCHOOL CITIZENSHIP PROGRAM” (“PROGRAM”) OPERATES (”TERMS AND CONDITIONS”). IN THESE TERMS AND CONDITIONS, “WE”, “US”, “OUR” AND “SAMSUNG” REFER TO SAMSUNG ELECTRONICS H.K. CO., LTD., “YOU”, “YOUR” AND “PARTICIPATING SCHOOL” ” REFER TO AN ELIGIBLE PARTICIPATING SCHOOL OF THE PROGRAM. PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ENROLLING IN THE PROGRAM, AS THEY FORM A LEGALLY BINDING AGREEMENT BETWEEN YOU AND SAMSUNG. BY PARTICIPATING IN THE PROGRAM, YOU AUTOMATICALLY CONFIRM THAT YOU HAVE READ, UNDERSTOOD, FULLY AGREE TO AND UNCONDITIONALLY ABIDE BY THESE TERMS AND CONDITIONS.



Program Details: Dates, Judges, Shortlisted Schools

 

1. You agree to be bound by these Terms and Conditions, and by the decisions of the judges and/or affiliated organizers, which are final as to all Program-related matters.
2. You are obliged to participate in random school site visits (during the application or after being selected) conducted by Samsung with advanced notice.
3. Samsung shall offer certain devices and software (“Samsung e-Learning Set”) to Participating Schools for use in the first semester of the 2015/16 school year, subject to additional terms and conditions.
4. Samsung reserves the right of final decision regarding the judgment method and selection result.
5. The result will be announced via email. You will be informed for further instructions of the Program if you are invited to participate. In case You are invited but cannot be contacted via email or telephone or you fail to follow the instructions to proceed, you will be deemed to have withdrawn from the Program. Samsung shall, in its sole and absolute discretion, reserve its right to give the place to an alternative Participating School. In the event of any dispute, all decisions of Samsung shall be final and binding.

 

 

Commitment 

 

6. Participating Schools are expected to assign teachers to complete a series of e-learning promotional activities within the first semester of the 2015/16 school year, before December 9, 2015 ("Completion Date"). The activities are designed for teachers to share their experience so as to build a better e-learning environment:
  • Submit 3 monthly activities reports to record their e-learning progress
  • Conduct a minimum of 2 open classrooms, workshops or seminars in respect of e-learning
  • Input activity details of open classrooms, workshops and seminars into an online calendar

 

 

Data/ Personal Information

 

7. All data transfer and receipt time shall be based on Samsung’s server, and subject to Samsung’s final decision. Samsung is not responsible for any data that is transmitted late, lost, incorrectly uploaded to other websites, or any information that is received but incomplete or illegible.
8. You declare and warrant that all data and information You provide is complete and accurate and are obliged to provide relevant documents for verification upon request. If the details You provide are incomplete, inaccurate (including but not limited to the use of a false e-mail address), inappropriate or illegible, or You impersonate another school to participate, Samsung will in its sole and absolute discretion disqualify Your eligibility in this Program.
9. You or Your related persons’ information will be collected to enable Samsung and its partners, including but not limited to Weber Shandwick, Hong Kong Education City, Association of I.T. Leaders in Education, eLearning Consortium and The Hong Kong Institute of Family Education (collectively called the “Organizers”) the rights to administer and use the information for the Program. The information may be provided to others assisting the organizers in this regard, including without limitation to co-organizers of the Program, judges, product deliverers, and authorities that regulate the Program. If You do not truthfully provide all the above requested information, the Organizers may solely determine that You shall not be eligible to take part in any way in the Program.
10. All application data and information collected are subject to Samsung’s privacy policy. For the details of Samsung’s privacy policy, please visit

11. We intend to use the collected data for direct marketing purpose of Samsung Corporate Social Responsibility (CSR / citizenship) related program. We may not use the data unless we receive the consent.

 

 

Disqualification

 

12. Samsung reserves the right in its sole and absolute discretion to disqualify any of the Participating Schools which Samsung reasonably believes that such school has breached any of these Terms and Conditions, or engaged in any unlawful or other improper misconduct lead to jeopardize the fair and proper conduct of the Program. Samsung reserves all legal rights to recover damages or other compensation from such an entry.

 

 

Program Changes

 

13. Samsung reserves the right to change the timing of Program, estimated dates of product delivery, product installation, training and any part thereof and any terms hereunder without prior notice to You.
14. Samsung will announce any substantive change to the Program by posting on the Program's website. Any changes or discontinuation will take effect from the date of public notification. Your continued participation in the Program will constitute acceptance to any changes made by Samsung. If You do not agree with any such changes, You  should write to Samsung to withdraw from the Program in accordance with clause 15 below and agree that Samsung shall not be liable to You for any loss or damages arising as a result of any such changes or discontinuation.

 

 

 Withdrawal

 

15. If at any time you wish to withdraw from the Program shall provide one month prior written notice to Samsung and Weber Shandwick via email or direct mail. 
16. If You have participated but fail to fulfill the commitment of "Giving Back" upon the Completion Date, You shall return the Samsung e-Learning Set to Samsung.

 

 

Disclaimer

 

17. Samsung, all participating partners and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies shall not be responsible or liable for: (a) any problem, loss or damage of whatsoever nature suffered by any party due to any delay and/or failure (including but not limited to lost entries, mail delay or loss) in registering for or participating in the Program as a result of any communication error, interruption, human error and/or failure by Samsung and/or any third party; (b) any problem, damage or loss of whatsoever nature to any person, resulting from, alleged to be resulted from or in connection with his/her participation in the Program; (c) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, or application lost or delayed whether or not arising during operation or transmission; or (d) any changes made by Samsung or any third party suppliers or its partners.

 

 

Miscellaneous

 

18. This Program and the Terms and Conditions shall be governed and construed in accordance with the laws of Hong Kong SAR and the courts of Hong Kong SAR shall have jurisdiction to hear all disputes relating to them.
19. All provisions of the Terms and Conditions shall apply to the maximum extent permitted by law. If any provision of these Terms and Conditions shall be held to be unlawful, void or unenforceable, then such provision shall be replaced with terms and conditions that most closely match the intent of Samsung and the remainder of the Terms and Conditions shall continue in full force and effect.
20. In case of any inconsistency between the English version and Chinese version of these Terms and Conditions, the English version shall prevail.
